GLOBAL VOICE AND DATA NETWORK SERVICES
ACCEPTABLE USE POLICY
THIS ACCEPTABLE USE POLICY APPLIES TO ALL GLOBAL VOICE AND DATA CUSTOMERS EFFECTIVE OCTOBER 7, 1998, UNTIL SUPERSEDED BY RELEASE OF A REVISED POLICY. THIS COPY IS PROVIDED FOR YOUR RECORDS, AND YOU SHOULD KEEP IT HANDY FOR READY REFERENCE. THE CURRENT POLICY IS AVAILABLE ON-LINE AT GLOBAL VOICE AND DATA'S WEB SITE (WWW.ALINK.NET).
1. LAWFUL USE OF SERVICES. No one may use Global Voice and Data
Internet Services for any criminal or unlawful purposes; or for
the transmission, creation or storage of any material in violation
of any applicable state or federal laws or regulations, including,
but not limited to, any material that is or has been:
a. in violation of United States Copyright Laws;
b. in violation of state or federal Trade Secret Laws;
c. previously judged in a court of law to be threatening or obscene;
d. in violation of the Telecommunications Act of 1996;
e. in violation of the Internet Consumer Protection Act of the State of California.
2. RESTRICTIONS. In addition to the above, Customer may not use the Services for any illegal or inappropriate purpose, including, but not limited to:
a. Libelous or slanderous use.
b. Uses that violate intellectual property rights, including but not limited to infringement of copyright, patent, trademark or design.
c. Export of controlled software.
d. Threats of bodily harm or property damage.
e. Fraudulent offers.
f. Deliberate or accidental denial of service to Global Voice & Data customers or other parties, including but not limited to SYN flood attacks, disabling or crippling of computer and/or routing systems through "hacking" or any attempt to gain unauthorized entry to systems or components.
g. Excessive e-mail or Usenet News postings impeding proper operation of the target system, mail list or newsgroup.
h. Misappropriation of service from Global Voice & Data customers or other parties, including but not limited to mail relaying via third party systems without specific authorization or any other use without explicit authorization of any Internet services belonging to others.
g. Broadcast transmission of unsolicited messages, including but not limited to, the deliberate transmission of bulk unsolicited e-mail, commercial or otherwise, sometimes called "spam".
h. Use of unsolicited e-mail messages sent via other networks advertising content on Global Voice and Data's network.
i. Use of e-mail address collection software or use of commercial lists causing users to receive e-mail without their express consent.
j. Transmission or relaying of e-mail messages with forged, hidden, spoofed or otherwise misleading header information.
k. Any use of a domain not allocated or properly delegated for use, including use of others' domains or any domain spoofing.
l. Transmission of forged or spoofed datagrams.
m. Transmission of virus software with the intent to damage recipient systems.
n. Interference with public postings by others.
o. Interference with the appropriate operation of Usenet newsgroups or Internet mailing lists, public and private, including, but not limited to, bulk, inappropriate or off-topic postings.
p. Deliberate or accidental disruption of the operation of the Global Voice and Data network or any other network.

3. PASSWORD PROTECTION AND SECURITY. If you are issued a system password, you are responsible for keeping it confidential, for changing it from time to time, and for any use made of your password, whether authorized or unauthorized.
4. MISCELLANEOUS. You may not run server processes (FTP, IRC, etc.) on any Global Voice & Data computer. User processes on Global Voice and Data's computers may not be disk-intensive and must consume less than 300KB of active memory. No automatically scheduled process ("cron", "at", etc.) may be run more than once hourly.
Suspension or termination of service for inappropriate use does not relieve the customer of obligation of payment for services rendered up to the time of suspension or termination.
Violation of this Acceptable Use Policy is grounds for immediate cessation of Services and termination of the agreement between you/your company and Global Voice & Data without warning or prior notice. Global Voice and Data may charge the account responsible expenses attributable to violation of this Acceptable Use Policy billed at the greater of $150.00 per person hour worked or $500 per incident.
